These Terms of Service (“Terms”) govern your use of LumiGap’s website, dashboard, and macOS application (the “Services”). By using the Services, you agree to these Terms.

1) Who we are

“LumiGap”, “we”, “us” refers to LumiGap, the provider of the Services.

2) Eligibility

You must be legally able to form a contract in your jurisdiction to use the Services. If you use the Services on behalf of an organization, you represent you have authority to bind that organization.

3) Accounts

  • You may need an account to access paid features.
  • You are responsible for maintaining the confidentiality of your credentials and all activity under your account.
  • You must provide accurate information and keep it up to date.

4) Subscriptions, billing, and payments

  • Paid plans provide access to certain features as described in the dashboard/app.
  • Payments are processed via Stripe. We do not store your full card details.
  • Subscriptions may renew automatically unless you cancel.
  • Taxes may apply depending on your location and applicable law.

Cancellations: You can cancel anytime via the dashboard/billing portal. Your access continues until the end of the current billing period unless stated otherwise.

Refunds: Except where required by law, fees are non-refundable. If you believe you were billed in error, contact [email protected] promptly.

5) License and permitted use

We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal or internal use, subject to these Terms.

6) Prohibited use (critical)

You agree not to use the Services to:

  • Violate any law or regulation.
  • Violate any third-party terms, including the rules/terms of poker platforms or games you use.
  • Engage in cheating, fraud, collusion, or deceptive conduct.
  • Circumvent, disable, or bypass restrictions or detection mechanisms of third-party platforms.
  • Provide or promote the Services as a way to guarantee profits, “win more money,” or evade platform restrictions.
  • Use the Services in contexts where real-time assistance is prohibited by the platform you are playing on.

You are solely responsible for how you use the Services and for ensuring your use is permitted by the applicable platform rules and laws.

7) No professional advice; no guarantees

The Services may output insights, visualizations, or “recommendations” derived from recognized table state or user-provided models/data. These outputs are for informational and educational purposes only and do not constitute financial, gambling, legal, or professional advice.

We do not guarantee accuracy, completeness, or usefulness of any output. You acknowledge that outcomes in any game or activity are uncertain and involve risk.

8) User content and data

  • You retain rights to content you create and store locally (datasets, manifests, models, logs, notes).
  • If you upload data to our systems (e.g., through the dashboard), you grant us a limited right to host and process it solely to provide the Services.
  • You represent you have the right to use and process any content you input, capture, or export, including screen content.

9) Device permissions and local processing

Some features require macOS permissions (e.g., Screen Recording). You are responsible for granting or revoking permissions and for compliance with applicable laws when capturing screen content.

10) Live Export and external endpoints

  • You control the destination endpoint and the interval.
  • You are responsible for securing that endpoint and complying with any obligations related to data transmission/storage at that endpoint.
  • We are not responsible for third-party systems you operate or connect.

11) Intellectual property

The Services (software, UI, branding, and related materials) are owned by LumiGap and protected by IP laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works except as permitted by law.

12) Service availability; changes

We may change, suspend, or discontinue parts of the Services, add or remove features, or set limits. We may also update these Terms from time to time.

13) Termination

We may suspend or terminate your access if:

  • You breach these Terms,
  • Your use creates risk or legal exposure for LumiGap,
  • We are required to do so by law.

You may stop using the Services at any time. Subscription cancellation rules are described above.

14) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMIGAP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15) Limitation of liability

  • LUMIGAP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
  • LUMIGAP’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO LUMIGAP FOR THE SERVICES IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF NONE, €0).

Nothing in these Terms limits liability where such limitation is prohibited by law.

16) Indemnity

You agree to indemnify and hold harmless LumiGap from claims, damages, liabilities, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any third-party rights or platform rules.

17) Governing law and disputes

These Terms are governed by the laws applicable to LumiGap as the service provider, without regard to conflict of law principles. Courts with appropriate jurisdiction will have exclusive venue unless applicable law provides otherwise.
